FNH provides
litigation funding for a variety of purposes. This funding can
range from a pre-agreed percentage of costs through to 100% funding
of all costs associated with a litigation, including:

review of all source documentation;
- evaluation of strategic options;
- selection and appointment of solicitor, barrister(s),
expert witness(es);
- all legal and consulting fees
including investigations, accountancy/audit and
expert witnesses; and
- all administrative fees, management fees, filing fees,
transcript fees and court costs.
We also
provide Bank guarantees to
support security for costs orders. An Application for
Security for Costs can be an early response by a Defendant. A bank
guarantee arranged by FNH to support the Plaintiff's indemnity can
prevent any problems arising from such an Application.
Our
clients can require funding for a number of
reasons. The funds we provide are based on our review and
assessment of factors including:

prima facie merits of the litigation;
- likely level of judgment that can be obtained;
- prospects of obtaining payment of any judgment;
- current stage of the litigation, including nature and
extent of work to date;
- overall timetable from commencement to completion; and
- our assessment of the likely costs to undertake all works
and meet all costs.
Our
experience in handling complex issues allows us to assess these
issues promptly, providing an adequate initial Brief is provided.

All
assessments are conducted in the strictest confidence. We will
respond with a written Litigation Funding Terms Sheet. The terms of
funding are established on a case by case basis. Our fees typically
range from 35% to 55% of any settlement,
after legal costs, whether obtained by Court Order
or by private agreement. In some cases we may require payment of
certain "out of pocket" costs as the litigation
proceeds.
No monies
are payable to FNH if no settlement is achieved unless expressly
stated to the contrary in the Litigation Funding Terms
Sheet.
