Litigation funding in Australia is a growing industry, as attitudes to the concept of litigation funding are changing in favour of the funders - the main reason being that Litigation Funding increases access to justice for parties who would not otherwise have it. Recent court decisions in both Australia and the UK support this trend.

As litigations progress, they can by their nature open the opportunity to expand the potential claim through the involvement of third parties, along Class Action lines. In one recent case (Fostif Pty Ltd v Campbells Cash & Carry Pty Ltd), the Litigation Funder is now seeking to locate as many of the potential plaintiffs it can in a representative proceeding against tobacco wholesalers for invalid excise paid in 1997. The defendants’ discovered documents allow them to locate more plaintiffs to add. This is known to the court and has not drawn any adverse judicial comment.
